THE FOLLOWING AGREEMENT ("AGREEMENT") SETS FORTH TERMS AND CONDITIONS UNDER WHICH INCA INTERNET INCORPORATED LIMITED AND THE END USER AGREE UPON. BY AGREEING WITH THE TERMS, YOU HAVE THE POWER TO ENTER A BINDING CONTRACT LAWFULLY. IF YOU DON’T AGREE WITH THESE TERMS, THEN PLEASE DON’T USE THE SERVICE.
1. Definitions
Capitalized terms shall have the meaning set forth below.
1. "MEMBER" means end user who has agreed to the INCA Internet Ltd. Software End User License Agreement and is using the service of INCA Internet.
2. “ID" means the identification information used for the service and to identify the member.
3. "PASSWORD" means the combination of characters and digits selected by the user to protect their account.
4. "EMAIL" means electronic mail used for sending and receiving messages electronically.
5. "TERMINATION" means termination of Software End User License Agreement by the user or INCA Internet.
6. "SERVICE" means service related to e-commerce and PC security service.
2. Use of Service
① To become a member user must sign-up to become a member.
② All submitted information has to be truthful and accurate and the user is responsible for all activities under the submitted information.
3. Change of ID
① INCA Internet may change the ID of the member for the following reasons.
1. If the ID includes any personal information of the member such as phone number
2. ID that is detrimental to good public morals or that is repulsive
3. If there is a reasonable reason for INCA Internet to change the ID
4. Software Feature and Content
① INCA Internet may provide one or more of the following services on a license basis and member may use one or more of them in combination.
1. Detection and removal of hacking tools that resides in memory
2. Detection and removal of hacking tools using real-time monitoring
3. Diagnosis of process using network resource using real-time monitoring (block / allow option)
4. Integrating online anti-malware for malware detection
5. APT Protection : Detecting and blocking malicious code execution by detecting the behavior of a program running on a PC
6 MBR Protection : Detecting and blocking the act of preventing PC booting by modifying MBR (Master Boot Record) area in order to damage PC's hard disk
7. Ransomware Protection : Detecting and blocking the execution of ransomware running on PC
8. Firewall : Protecting systems and networks by inspecting inbound and outbound network traffic
9. Various security solutions and programs developed by other companies
② INCA Internet may add or change the content of the services if necessary. In this case, it will notify the member of the addition or change on the homepage.
5. Service Fee
① Security service is provided in two types : Free and Premium.
② Premium service license period is 1-year.
③ Member can access the premium service through purchasing a license..
④ INCA Internet may change the premium license fee by notifying the Member before the changes.
⑤ INCA Internet is not responsible for the damages caused by the external environment like firewall and other network issue of the Member resulting in not being able to use the service.
6. Information and Ads
① INCA Internet may display various information on the software.
② INCA Internet may display ads in the software, homepage, email etc.
7. Cease of Service
INCA Internet may cease service for the following reasons.
1.For maintenance reason
2.When the telecommunications carrier no longer provide telecommunication service
3.When INCA Internet can no longer provide the service
8. Protection of Privacy
① INCA Internet shall not disclose or distribute the personal information of the member acquired in connection with the service to any other person without the prior consent of the member except for the following cases and shall not be used for commercial purposes other than those related to the service.
1. Requested by the relevant authorities for investigation purposes under relevant laws and regulations
2. At the request of the Information Communication Ethics Committee
3. In case of other related laws
② Within the scope of the preceding paragraph, INCA Internet may create and use statistical data on the personal information of all or a part of the members in connection with the advertising business and may transmit the cookie to the member's computer through the service. In this case, the member can change the browser settings of the computer that they use to refuse to accept cookies or to warn them of cookies.
9. Member Obligations
① Member must abide by the relevant laws and regulations, the provisions of these Terms of Use, instructions for use and precautions, and should not interfere with the work of INCA Internet.
② Member cannot use the service for any profit without prior consent of INCA Internet.
③ Member may not copy, reproduce, modify, translate, publish, broadcast or otherwise use the information obtained from the service or provide it to others without INCA Internet's prior consent.
10. License
Member may not, nor permit any other person to:
① sublicense, rent or lease any portion of the Software;
② reverse engineer, decompile, disassemble, modify, translate, make any attempt to discover the source
code of the Software or create derivative works from the Software;
③ use the Software as part of a facility management, timesharing, service provider or service bureau
arrangement; or
④ use the Software in any manner that is not permitted pursuant to this License Agreement.
11. Deleting Account
① Free member can delete their account through the website after logging in.
② Premium member can delete their account by logging into the website, email after the refund process has been cleared. However, refund may not be possible if the license period has been progressed for specific amount of time.
③ Deleted account information will be completely wiped from the database. (However, payment history is maintained for a certain period.)
12. Refund Policy
① Violation of this agreement may result in service cancellation and no refund shall be made.
② INCA Internet deducts and refunds the amount paid by the Member at the time of the initial service multiplied by the number of days of actual service and daily use amount.
- Refund Calculation: Paid Amount - [Original Amount(Before Discount) * days of use / 365] = Refund Amount
④ The amount refunded to a paid member who has withdrawn from the service shall not exceed the initial amount paid by the member.
⑤ INCA Internet may deduct the transaction fee from the refund amount for the convenience of the payment service in case of refund.
13. Compensation for Damages
① INCA Internet shall not be liable for any damages incurred by member in connection with the service provided free of charge, except in case where such damages are caused by INCA Internet intentionally or gross negligence.
② INCA Internet shall not be liable for the suspension of the service if the service is notified to the premium members in advance.
③ If the premium member wasn’t able to use the license base service for more than 6-hours continuously from the point when the member notified INCA Internet about the issue or INCA Internet knew about the issue then INCA Internet is responsible for the claim made by the member.
14. Claim for Damages
① Claims for damages shall be made in writing to the Company by stating the reasons for the claim, the amount of the claim and the basis for the calculation.
② A claim for damages shall cease to exist if the claim is not exercised within three months from the date of the claim. This is also true if 1-year has elapsed since the date of the claim.
15. Immunity
① INCA Internet shall not be held responsible for the contents of the information posted by the member on the service, the data, the accuracy of the facts and the reliability.
② Member shall use the service under their responsibility and shall be liable for any damages incurred in connection with the use of the service or any damage caused to the posted or transmitted data.
③ INCA Internet shall not be liable for any obstacle to the use of the service caused by the member.
④ INCA Internet shall not be liable for any loss of revenue that the member expects by using the service. In addition, INCA Internet does not guarantee the accuracy of the data provided through the service and is not responsible for the damage caused by it.
16. Resolution of Disputes
① INCA Internet and the members shall make every effort to resolve any dispute arising in connection with the service.
② In the event of a dispute, the court of competent jurisdiction shall be the one that has the jurisdiction over the headquarters of INCA Internet.
